The transfer of criminal cases in India is governed by sections 406 to 412 of Chapter XXXI of the Criminal Procedure Code (CrPC). These sections include:
Section 406: The Supreme Court has the power to transfer cases and appeals
Section 407: The High Court has the power to transfer cases and appeals
Section 408: The Sessions Judge has the power to transfer cases and appeals
Section 409: Sessions Judges can withdraw cases and appeals
Section 410: Judicial Magistrates can withdraw cases
Section 411: Executive Magistrates can withdraw or make over cases
Section 412: Requires that the reasons for any transfer order be recorded in writing  
 
A party seeking a transfer of ongoing proceedings must provide specific grounds that amount to a miscarriage of justice. Some grounds that courts consider include:
Jurisdictional error
Threat to life
Prejudice in existing jurisdiction
Financial difficulty
Medical conditions
Ensuring a fair trial
